Terms of Use
These Terms of Use govern your access to and use of the Litigation Strategy Partners website and, where applicable, its client portal. By accessing or using the website or portal, you agree to these Terms of Use. Last Updated: September 2026.
1. Nature of Services
Litigation Strategy Partners provides strategic consulting and advisory services to attorneys, law firms, and legal teams. Dr. Keith Ablow is retained by counsel rather than by individual parties represented by counsel.
Nothing contained on this website constitutes legal advice, medical advice, psychiatric evaluation or treatment, or any other form of professional healthcare service. Use of this website, the client portal, or the services described on this website does not create a physician-patient relationship.
Litigation Strategy Partners and Dr. Ablow do not provide legal representation. Nothing on this website creates an attorney-client relationship between Litigation Strategy Partners, Dr. Ablow, any attorney or law firm, or any user of the website.
2. No Engagement Created by Website Use
Accessing this website, contacting Litigation Strategy Partners, submitting an inquiry, or transmitting information through the website or client portal does not, by itself, create a consulting or advisory relationship.
An engagement exists only after Litigation Strategy Partners and retaining counsel have mutually agreed to the engagement.
Where a separate written engagement agreement exists, that agreement governs the professional engagement and will control in the event of any inconsistency between that agreement and these Terms of Use.
3. Client Portal
The client portal is intended for attorneys, law firms, and other specifically authorized users to exchange information and communicate with Litigation Strategy Partners regarding pending or prospective engagements.
Users are responsible for safeguarding their login credentials and for all activity conducted through their accounts. Login credentials should not be provided to unauthorized individuals. Suspected unauthorized access should be reported promptly.
The availability or use of the portal does not, by itself, establish that any particular communication or material is protected by attorney-client privilege, attorney work-product protection, or any other legal privilege or protection. The existence and scope of any such protection depend upon the circumstances of the engagement and applicable law.
4. Confidential Information
Litigation Strategy Partners recognizes that its work may involve confidential, sensitive, privileged, or litigation-related information. Information received in connection with an accepted engagement will be handled in accordance with the applicable engagement agreement and applicable law.
Prospective users should exercise appropriate judgment before transmitting highly sensitive information prior to confirmation that an engagement has been accepted.
Nothing in these Terms is intended to expand, waive, or otherwise determine the existence or scope of any attorney-client privilege, work-product protection, confidentiality obligation, or other legal protection that may otherwise apply.
5. No Guarantee of Outcomes
Litigation Strategy Partners provides strategic analysis, insight, and recommendations. Litigation and dispute resolution are inherently uncertain, and many factors affecting an outcome are beyond the control of any consultant, attorney, or party.
Accordingly, Litigation Strategy Partners makes no representation, warranty, or guarantee regarding the outcome of any litigation, negotiation, investigation, proceeding, or other matter.
6. Informational Content
Materials appearing on this website are provided for general informational purposes and to describe the nature of the services offered by Litigation Strategy Partners.
Website content should not be relied upon as a substitute for advice from qualified legal, medical, mental-health, financial, or other professionals appropriate to a particular situation.
Past matters, representative situations, observations, commentary, or examples described on the website, if any, do not guarantee or predict results in any other matter.
7. Permitted Use
You may use this website only for lawful purposes and in a manner consistent with these Terms.
You may not attempt to gain unauthorized access to the website, client portal, user accounts, servers, systems, or networks; interfere with the operation or security of the website or portal; introduce malicious software or code; impersonate another person or organization; or use the website in violation of applicable law.
Litigation Strategy Partners may restrict or terminate access to the client portal when reasonably necessary to protect users, information, systems, or the integrity of the service.
8. Intellectual Property
Unless otherwise indicated, the text, graphics, branding, methodologies, frameworks, and other original content appearing on this website are owned by or licensed to Litigation Strategy Partners and are protected by applicable intellectual-property laws.
Website content may be viewed and used for personal or internal professional purposes but may not be reproduced, republished, distributed, sold, or commercially exploited without prior written permission, except as permitted by law.
9. Website Availability and Security
Litigation Strategy Partners takes reasonable measures to maintain the website and client portal but does not warrant that either will operate without interruption, error, delay, or security vulnerability.
No electronic communication or storage system can be guaranteed to be completely secure. Users should use appropriate care when transmitting particularly sensitive information electronically and should contact Litigation Strategy Partners regarding alternative transmission arrangements when circumstances warrant.
10. Third-Party Services and Links
The website or client portal may contain links to, or utilize services provided by, third parties. Litigation Strategy Partners does not control and is not responsible for the content, availability, privacy practices, security, or performance of third-party websites or services.
Use of third-party services may also be subject to the terms and privacy policies of those providers.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website, client portal, and informational content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
Nothing in this section limits any obligation expressly undertaken by Litigation Strategy Partners in a separate written engagement agreement.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Litigation Strategy Partners and its principals, employees, consultants, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from access to or use of, or inability to access or use, this website or client portal.
This limitation applies to website and portal use and is not intended to modify any rights or obligations expressly established in a separate written engagement agreement.
13. Privacy
Use of this website and the handling of personal information are also subject to the Litigation Strategy Partners Privacy Policy.
Because materials exchanged in connection with litigation may contain information concerning third parties, users are responsible for ensuring that they are authorized to provide materials they submit through the website or client portal.
14. Changes to These Terms
Litigation Strategy Partners may revise these Terms of Use from time to time. The current version will be posted on this website together with its effective or last-updated date.
Continued use of the website following the posting of revised Terms constitutes acceptance of those Terms to the extent permitted by applicable law.
15. Governing Law
These Terms of Use are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.
Any dispute arising solely from the use of this website or client portal will be subject to the jurisdiction of the state and federal courts having jurisdiction in Massachusetts, except where applicable law requires otherwise.
16. Contact
Questions regarding these Terms of Use, the client portal, or the handling of information submitted through the website may be directed to Litigation Strategy Partners through the contact information provided on this website.
